General Conditions of Carriage.
In these conditions, “we”, ‘’us’’ and “the Company”, refers to (Norway Yacht Charter As& Båtservice Sightseeing As) and “you”, ‘’your’’ refers to the (Customer). GCC refer to these general conditions of carriage.
We are in the business of running ferries, scheduled sightseeing vessels in the Oslo Fjord and private hiring – charter - of the vessels for private pre -arranged trips i.e. Fishing, Jubilees, Weddings, Company tours, Birthdays etc.
These Terms and Conditions of booking cover all direct bookings with us including sightseeing and charter and event bookings. Whilst the majority of the GCC cover all products please be aware of the variations particularly in regard to cancellations and amendments.
1.Contract of carriage.
There shall be no claim to be carried by a certain ship / type of ship. The Company may perform the carriage and all services appurtenant to the carriage itself, using either vessels of its own or charter vessels, or by involving other shipping lines whose performance will correspond to that rendered by the Company itself. The Company is not under obligation to guard any luggage or special cargo brought on board, neither during the voyage nor while the vessel is at harbor. The Companygenerally recommends that passengers cover their risk of theft or loss by taking out the corresponding insurance.
2.Tickets, loss and transferability of tickets.
Under the contract of carriage, the Company shall issue to the passenger a carriage document prior to departure (this may be a ticket or a booking confirmation -referred to hereafter as “ticket”). The passenger – and in the case of travel groups the group leader – shall receive the ticket at departure by purchasing it in the harbor, or on board by submitting the booking confirmation or payment by cash or card. In the case of personalized electronic tickets, there will be a claim to carriage only in those cases in which the passenger has provided satisfactory identification and a valid electronic ticket has been issued in the passenger’s name. For all other tickets, a claim to carriage will exist only upon a valid ticket being submitted that is not subject to significant damage. A placard at purchase point or on board will detail current ticket validity.
In the case of non-personalized tickets: Lost or mislaid tickets will not be replaced. In the case of personalized tickets: Lost or mislaid tickets will be replaced, provided the passenger is able to satisfy the Company that the ticket originally has been properly issued and has been paid, and that the ticket has not already been used to obtain carriage or a refund, or has not already been replaced, without this being the result of negligence on the part of the Company. The pre-requisite for obtaining a replacement for a lost / mislaid ticket is an undertaking by the passenger to pay the fare for the lost / mislaid ticket retroactively if and to the extent the lost / mislaid ticket should be used to obtain carriage or a refund by someone else. The Company does not demand refunds for any losses that wehas caused negligently or intentionally.
4.Transferability of tickets.
In the case of non-personalized tickets: The ticket shall be transferable until boarding. In the case of special fare brackets (e.g. fares for children or seniors), the ticket may be transferred only subject to the conditions applying under the special fare bracket, and only to such persons meeting the conditions applying to the special fare bracket. Personalized tickets are not transferable.
The passenger agrees to the personal data that will be transmitted to the Company in the context of the booking being stored, processed, and used for purposes of establishing, implementing, and terminating the contract of carriage, for customer care purposes, for providing any additional services that may have been booked and for settling them, and/or in order to comply with statutory requirements in connection with the carriage, and to such personal data being forwarded, exclusively for the above purposes, to government authorities, the travel agency issuing the tickets, or other providers of the services set out above. We on our side will only use such data as stated and within the requirements of the Norwegian laws for personal data protection.

For your own safety and the safety of others, you must follow instructions given by our crew when embarking/disembarking or on board any of our vessels. Instructions and on-board safety notices shall be followed. The Captain may refuse to carry any passengers, or direct any passenger to disembark, where the behavior of that passenger is likely to cause irritation or offence to the other passengers or put at risk the safety of the passenger, other passengers, crew or vessel. Not all of our vessels and facilities onboard have been designed or adapted for passengers in wheelchairs, for example use stairs is on most vessels required to go to the bathroom. There is also limited capacity to accommodate wheelchairs, please contact us before the trip so we can plan together accordingly. 4.6.
